By creating an account on IndianPartners.com, the member agrees to be exclusively bound by the terms and conditions of this agreement. This agreement shall remain binding between the member and the company for as long as the member holds an active account with the company. If the member does not agree to any of the terms and conditions stipulated in this agreement, it is agreed and understood that the member shall not create an account with the company.

1. The company reserves the right to add, change or modify any aspect or feature of the company's website as it deems appropriate. The member agrees that the company may make such amendments to any and all information on the company's website, including, but not limited to, the member's personal information, without requiring permission from the member. In this regard, the member and the company agree that the company is the sole owner of the information on this website.

2. The member agrees that he or she will not in any way misrepresent any information regarding himself or herself, including, but not limited to age, height, qualifications, area of residence etc.

3. The company hereby states that this website service is for persons of at least 18 years of age. The member acknowledges that he or she is at least 18 years of age at the time of creating an account on this website. The member agrees that any misrepresentation of age or any other personal information may result in the deletion of the member's profile from the website, and could lead to legal prosecution as deemed appropriate by the company.

4. The member and company agree that either member or company may terminate the membership of the member at any time, for any reason, without need for any communication. It is also agreed and understood by the member that the company shall reserve the right to immediately suspend or terminate the member's access to the company's websites, without notice, upon any breach of this Agreement.

5. The member agrees not to authorize any other persons to use the membership, nor shall the membership be assigned or otherwise transferred to any other persons.

6. The member agrees that to use the IndianPartners.com website in a non-abusive, professional manner. This includes agreement to not post any materials or information to the company's websites which may be considered defamatory, inaccurate, abusive, obscene, profane, offensive sexually oriented, threatening, harassing, or racially offensive by any parties at any time. The member further agrees not to post any illegal material, or any material that infringes or violates another party's rights (including, but not limited to, intellectual property rights, and rights of privacy and publicity). The member agrees that any failure to adhere to these agreements could result in legal prosecution.

7. The member agrees not to use the company's website for any purposes other than the sole purpose of seeking a relationship / matrimonial match. The member agrees not to post or transmit through the site any material that contains advertising or any solicitation with respect to products or services without the company's express written prior approval.

8. The member agrees not to use the site to advertise or perform any commercial solicitation, including, without limitation, the solicitation of users to become subscribers of other on-line information services. The member agrees not to engage in advertising to, or solicitation of, other members to buy or sell any products or services through the company's websites.

9. The member agrees not to transmit any chain letters or junk E-mail to other members of the company's websites. The member explicitly agrees not to use the company's websites and proprietary information (including, but not limited to information of members) to attract new members for a competing service.

10. The member agrees not to include within the member's profile any information, which may at any time by any persons be considered offensive, including but not limited to sexual references and sexually suggestive or connotative language. The member further agrees not to post any photos containing nudity, unauthorized personal information, cartoons, or photos which are not of the member.

11. The member agrees that in the event that the member submits payment for any fee-required service on this website (such as the IndianPartners.com Platinum account), the account shall not be available to the member until such time that the payment has been cleared from processing, and the required funds have been received by the company. The company agrees that in any instance where the member has submitted payment for a service on this website, the company shall make all efforts to provide the required services to the member as expeditiously as possible following the deposit of the member's required payment in the company's accounts.

12. The member agrees not to post any information which contradicts the agreed use of this website, including any contact information such as telephone numbers, street addresses, URLs, and E-mail addresses.

13. Liability: The member expressly agrees that the use of the company's website is at the member's sole risk and decision. Neither the company, its affiliates, partners, nor any of their respective employees agents, third party content providers or licensors warrant that the site will be uninterrupted or error free.

14. Liability: The company makes no warranty as to the results that may be obtained from the use of this site. The member explicitly agrees to use the company's websites based on his own decision and judgment.

15. Liability: In no event will the company, or any person or entity involved in creating, producing or distributing the company's websites or the content included therein, be liable in contract, in tort (including for its own negligence) or under any other legal theory (including strict liability) for any damages, including, without limitation, direct, indirect, incidental, special, punitive, consequential or similar damages, including, without limitation, lost profits or revenues, loss of use or similar economic loss, arising out of the use or inability to use the site.

16. This Agreement shall be construed in accordance with the laws of the State of Colorado, without regard to its conflict of laws rules and you hereby consent to exclusive jurisdiction in the state and federal courts of Colorado for any cause of action, claim, liability, demand or dispute arising out of your use of this site or its Terms of Use. Unless otherwise explicitly stated, the Terms will survive termination of your membership to the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
